कित्ताकाट नियन्त्रण फुकवा

सरकारले कृषि योग्य जमिनमा गरिएको कित्ताकाट नियन्त्रणलाई फुकुवा गर्ने भएको छ । अख्तियार दुरूपयोग अनुसन्धान आयोगको सुझावलाई समेत सम्बोधन गर्दै कित्ताकाट फुकुवा गरिएको हो ।

कित्ताकाट फुकुवा गर्न भूमि व्यवस्था मन्त्रालयले नापी, तथा भूमि व्यवस्था तथा अभिलेख विभाग सहितका उच्च कर्मचारीहरूसँग दुई/तीन चरण छलफल गरेको छ । छलफलको क्रममा अभिलेख तथा नापी विभागका उच्च कर्मचारीहरूले कृषियोग्य जमिनमा कित्ताकाट नियन्त्रण गर्ने गरी मन्त्रालयले जारी गरेको निर्देशिका जटिल र दोहारो अर्थ लाग्ने भएकोले अख्तियारले दिएको निर्देशनलाई कार्यान्वयन गर्न राम्रो हुने सुझाव दिएका छन्। ‘कृषि योग्य जनिमनमा गरिएको कित्ताकाट नियन्त्रण फुकवा गर्ने विषयमा मन्त्रालयले नापी, भूमि व्यवस्था तथा अन्य सम्बन्धित निकायसँग छलफल गरीरसकेको छ।

कित्ताकाट फुकवा गर्न मन्त्रालयले यसअघि २०७४ साउन २६ र २०७५ पुस २७ गते निर्देशिका जारी गरेका थियो । कित्ताकाट नियन्त्रण फुकवा गर्न उक्त निर्देशिका निष्कृय गर्ने तयारीमा सरकार जुटेको छ ।

तत्कालिन भूमि सुधार मन्त्रालयले कित्ताकाट रोक्न गत २०७४ साउन २६ मा तत्कालिन मालपोत तथा नापी विभागलाई निर्देशन दिइ एक आथिक वर्षमा एक पटक मात्र कित्ताकाट गर्न आदेश गरेको थियो । सो आदेश विपरित नापी र मालपोत कार्यालयका कर्मचारीहरूले एक वर्षमा एउटै जग्गा पटक पटक कित्ताकाट गरेका थिए । कित्ताकाट नियन्त्रण गर्न २०७४ साउन २६ को निर्देशनलाई नापी र मालपोत कार्यालयका कर्मचारीहरू कमाइ खाने भाँडो बनाएको गुनासो बारम्बार आउन थाले पछि भूमि व्यवस्था मन्त्रालयले सो निर्देशिकालाई परिमार्जन गर्दै २०७५ पुस २७ मा अर्को निर्देशिका जारी गरेको थियो ।

पुस २७ मा जारी गरिएको निर्देशिकामा कृषियोग्य किसिम कायम भएका जग्गामा मात्र कित्ताकाट नियन्त्रण गर्न निर्देशिन गरिएको थियो । उक्त निर्देशिका पनि कार्यान्वयन गर्न जटिलता उत्पन्न भएको नापी र मालपोत कार्यालयका कर्मचारीहरूले गुनासो गर्दै आएका छन् । सो निर्देशिकामा उल्लेखित केही बुँदा दोहारो अर्थ लाग्ने भएको र कुन ÷कुन अवस्थामा कित्ताकाट फुकवा गर्ने भन्नेबारेमा अस्पष्ट प्रावधान राखिएको मालपोत र नापी विभागका कर्मचारीहरूको गुनासो थियो ।

‘कृषि योग्य जमिनमा मात्र कित्ताकाट नियन्त्रण गर्न २०७५पुस २७गते मन्त्रालयले जारी गरेको निर्देशिका कार्यान्वनय गर्न जटिल प्रक्रिया छ र निर्देशिका राखिएका केही बुँदा दोहारो अर्थ लाग्ने छ’भूमि व्यवस्था विभागका महानिर्देशिक ले भने,‘त्यसैले कृषियोग्य जमिनमा लगाइएका कित्ताकाट फुकवा गर्ने विषयमा मन्त्रालयले हामीसँग छलफल गरेको हो ।’

मन्त्रालय स्रोतका अनुसार अख्तियारबाट मन्त्रालयलाई दिइएको निर्देशनमा मन्त्रालयले कित्ताकाटसम्बन्धी जारी गरेको निर्देशिकामा थप समस्या र जटिलता उत्पन्न गराएको भन्दै कित्ताकाट खुला गर्ने विषयमा आवश्यक व्यवस्था मिलाउन सुझाव दिइएको छ । कृषियोग्य जमिनमा कित्ताकाट गर्ने नियन्त्रण गर्ने मन्त्रालयको निर्देशन प्रभावकारिता नदेखिएको र उल्टै यसले थप जटिलता र अनियमितता उत्पन्न भएको अख्तियारले जनाएको छ । अख्तियारले अघिल्लो साता यस्तो निर्देशन दिएको थियो ।

अख्तियारले सरकारलाई पठाएको निर्देशनमा भूमिको समुचित उपयोग तथा दिगो लाभ हासिल गर्न भूउपयोग ऐन २०७६ जारी भएको र भूमि सम्बन्धी ऐन २०२१को आठौं संशोधन कार्यान्वयन भएको अवस्थामा सरकारले २०७५मा जारी गरेको निर्देशिका लागु गरिरहन आवश्यक नभएको जनाइएको छ । भूउपयोग ऐनमा भूमिको उपयोग सम्बन्धी व्यवस्था गरिएको छ । मन्त्रालय स्रोतका अनुसार मन्त्रालयका उच्च कर्मचारीहरू अख्तियारको निर्देशनलाई लागु गर्ने पक्षमा उभिएका छन् । ‘कित्ताकाट नियन्त्रणको नाममा नापी र मालपोत कार्यालयका कर्मचारीहरूले सर्वसाधारणमा भ्रम सिर्जना गरी अनियमितता गर्ने गरेको गुनासो बारम्बार आउने गरेको पाइएको छ,’मन्त्रालयका एक उपसचिव भन्छन,‘त्यसैले कित्ताकाट नियन्त्रण सम्बन्धी सबै किसिमका भ्रम हटाउन मन्त्रालयले कित्ताकाट फुकुवाको निर्णय तत्काल गर्न आवश्यक छ ।’

मन्त्रालयले २०७५ पुस २७मा जारी गरेको निर्देशिकामा खेती योग्य जग्गा भन्नाले फिल्डमा कृषियोग्य किसिम कायम भएका कित्ता जग्गाहरू वा फिल्डबुक स्रेस्तामा अबल दोयम, सिम वा चाहार किसिम भनेर जनाइए पनि सम्बन्धित स्थानीय तहले जग्गाको मौजुदा अबस्था र निर्धारित अन्य मापदण्डको आधारमा खेती योग्य जग्गा भनी निर्धारण गरेको कित्ता जग्गालाई सम्झनु पर्ने छ भनी व्यवस्था गरिएको छ । यसैगरी निर्देशिकमा अदालतको फैसला बमोजिम कित्ताकाट गर्न कुनै बाधा पर्ने छैन भनिएको छ तर कृषि योग्य जमिनको खण्डिकरण हुने गरी भएको मिलापत्र बमोजिम कित्ताकाट गरिने छैन भनि निर्देशिकामा व्यवस्था गरिएको छ ।

अंशबन्डा र कित्ताकाट गर्न एक्दमै झन्जत र अप्थ्यारो भयपछी मिती २०८० साउन २९ गते बसेको मन्त्रिपरिषद को बैठकले पुरानो निर्णयलाई बदर गर्दै नंया निर्णय गरेको छ। पुरानो निर्णय अनुसार आवासिय जग्गा को हक मा १३० बर्गमिटर अर्थात(४ आना डेढ दाम) मात्र कित्ताकात हुन्थ्यो भने हाल को नंया निर्णय अनुसार ८० बर्गमिटर अर्थात( साढे दुई आना ०-२-२-०) सम्मको कित्ताकाट गर्न पाइने भएको छ । तर जग्गाको बर्गिकरण भने रोकिएको हैन ।
